Eligibility
Open only to legal residents of the District of Columbia and the forty eight (48) continental United States who are 18 years of age or older. Employees, officers and directors of Sponsor and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they may reside) and those living in the same household whether or not related, and Sponsor’s advertising and promotion and public relations agencies are ineligible. This Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted.
To Participate
How To Enter: You (“Entrant”) may enter this Sweepstakes by visiting the Facebook.com page for MyNewPlace.com (http://www.facebook.com/mynewplace) and clicking on the “LIKE” button to Enter.
Limit one entry per person and/or email address. Incomplete or ineligible entries are void and will be disqualified. Duplicate entries will be voided. Entries generated by script, macro or other automated means or by any means which subvert the entry process will be void. By submitting the entry you understand that the entry will be posted on Facebook.com for viewing by the general public. Sponsor is not responsible for malfunctions of electronic or telephone equipment, computer hardware, software, malfunctions of Entrant’s email provider or ISP, late, lost, incomplete misdirected entries or entries not received in time for the drawing. Entries become the sole property of Sponsor and will not be returned. Proof of transmission does not constitute proof of delivery. Online entries will be deemed to have been submitted by the Entrant utilizing the e-mail address provided. In case of a dispute as to the identity of the Entrant using the Internet, the authorized account holder of the email address connected to the winning Facebook account used to enter the Sweepstakes at the time of entry will be considered the Entrant.
Entry Period
The Sweepstakes commences at 12:01 AM PT on March 14, 2011 and ends at 11:59 PM PT on April 30, 2011. To be eligible for the Grand Prize, entry must comply with these Official Rules and be received by Sponsor by 11:59 p.m. PT on April 30, 2011. Only those entries submitted and received during the aforementioned dates are eligible to win.
Prizes and Timing
Grand Prize: One (1) iPad2 (16 GB with Wi-Fi in Black)
Approximate Value: TOTAL PRIZE VALUE is $499.00.
Approximate retail value (ARV) of prize is $499.00.
Odds of receiving a prize depend on the number of entries.
One Grand Prize winner will be selected by random drawing from all eligible entries received by a judge who is an employee of Sponsor. The drawing will be held on or about May 2, 2011. Winning a prize is contingent on fulfilling all requirements (including eligibility) set forth herein. All prizes will be awarded. Winner will be notified by email at the email address supplied. In the event that any email notification is returned as undelivered, Sponsor will attempt to re-send said email up to 5 times. If a winner does not respond to the e-mail notification within seven (7) days from the first attempt at email contact, the prize will be forfeited and an alternative winner will be selected. It is the sole responsibility of the Entrant to notify the Sponsor in writing if the Entrant changes his/her email address. To do so, please advise MyNewPlace of a change of email address by writing to MyNewPlace.com, Attention: ADDRESS CHANGE FOR iPad2 SWEEPSTAKES, 343 Sansome Street, Ste. 700, San Francisco, CA 94104 or emailing us at ipadgiveaway@mynewplace.com.
Miscellaneous
All federal, state and local taxes, and all income and any other taxes, fees and surcharges will be the sole responsibility of the winner. Winner will be issued an IRS Form 1099 Income Tax Form in the amount of the ARV of any total prizes accepted over $600. Winner cannot assign or transfer his/her prize to any other person or entity. Winner must complete a W-9 form, an Affidavit of Eligibility, a Liability Release, and a Publicity Release (where permitted by law) and return them within five (5) days as a condition of receiving a prize. Sponsor reserves the right to verify eligibility. Failure to return the completed documents or provide required information within the required time frames will result in disqualification. Winner consents to use of his/her name and/or photograph for promotional purposes without additional compensation, unless prohibited by law. No substitution, assignment or transfer of prize is permitted except by Sponsor due to unavailability, in which case a similar prize of equal or greater value will be provided. Sponsor is not responsible or liable for the acts of third parties. Sponsor will not replace any lost or stolen items. Only stated prizes will be awarded and prizes have no cash value.
Additional Conditions
The Sweepstakes is governed by the laws of the State of California, with venue and jurisdiction in San Francisco, California, and all claims must be resolved in the courts of San Francisco, California. By entering, Entrant agrees: (1) to release and does release Sponsor and Facebook from all liability, loss or damage arising out of his/her participation in the Sweepstakes and with respect to his/her acceptance and use/misuse of the prize; (2) to be bound by these Official Rules and the interpretations of these rules by Sponsor; (3) that the decision of the judge is final and binding on all matters relating to the Sweepstakes; and (4) except in Tennessee and where otherwise prohibited by law, Sponsor, its successors, licensees and assigns may use their name, likenesses and entry submissions in connection with the Sweepstakes and for advertising, publicity and promotion purposes in all media worldwide (including online) in perpetuity without additional compensation. Winner assumes and will hold Sponsor harmless for any liability for injuries or damages of any kind caused or claimed to be caused by participating in the Sweepstakes, or by the acceptance, possession or use of any prize. A person found tampering with or abusing any aspect of this Sweepstakes as solely determined by Sponsor will be disqualified. In the event the Sweepstakes is compromised by a non-authorized human intervention or other causes beyond the control of Sponsor which, in the opinion of Sponsor, corrupt or impair the administration, security, fairness or proper play, or if the Sweepstakes cannot be operated, conducted or completed as planned, for any reason, Sponsor reserves the right in its sole discretion to suspend, cancel, modify or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration, notice will be posted at http://www.mynewplace.com. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DAMAGE DELIBERATELY ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
